The JURDI association continues its action before the Court of Justice of the European Union (CJEU) so that the European Union finally respects its commitments in the face of massive violations of international law in Gaza.
Two phases are underway; they should be distinguished:
1. Substantive legal action: seeking to have the EU's inaction condemned
Our main appeal aims to have the culpable failure of the European Commission and the Council of the European Union recognized.
For months, they have refused to respond to our clear demand: to suspend the EU-Israel association agreement, freeze assets, impose an arms embargo, among other things, in view of the serious human rights violations committed in Gaza.
We ask the Court to acknowledge this inaction as illegal, contrary to European commitments and fundamental principles of international law.
2. Urgent: an expedited procedure to obtain provisional measures
Because waiting for a judgment on the merits can be lengthy, we also initiated interim proceedings on July 25, 2025, to obtain urgent and temporary measures. The Court has already set a deadline of August 11, 2025, for the Commission and the Council to submit their observations. These have already been served.
This is a strong signal: our appeal is being taken seriously and is progressing at a good pace.
Meanwhile, the European Commission is starting to move.
On July 29, the European Commission met in an extraordinary session. According to several sources, it decided to partially suspend Israel's participation in the European Horizon Europe program (specifically the "EIC Accelerator" initiative dedicated to innovation).
- This suspension, even partial, is unprecedented. It targets sensitive areas such as technology, artificial intelligence, and cybersecurity.
- And most importantly: unanimity between member states is not required. A qualified majority is sufficient, which paves the way for faster decisions.
Why is this crucial?
Because the agreement between the EU and Israel is based on a clear and fundamental clause (Art. 2): respect for human rights and democratic principles.
However, recent reports (ICJ, UN experts, NGOs) warn of serious violations: blockade of humanitarian aid, mass destruction, indiscriminate bombing, etc. The European Union can no longer turn a blind eye.
The next steps
- August 11, 2025: Expected response from institutions in the summary proceedings.
- Coming soon: continuation of the substantive proceedings and voluntary interventions by major NGOs, platforms and groups of Palestinian victims.
- Coming soon: our citizen and legal mobilization continues, in complete transparency. Together, let's uphold the law!
