The association Jurists for Respect for International Law (JURDI) notes with concern the significant number of criminal proceedings initiated since October 7, 2023 for glorifying terrorism against individuals in France who have made statements relating to the Israeli-Palestinian conflict.
She is particularly concerned about how these remarks are being classified by French courts. This wave of legal action is based on an analytical error: judging remarks relating to an international armed conflict and a situation of military occupation solely through the lens of anti-terrorism legislation.
Such an approach not only obscures international law and ultimately weakens it, but also transforms the offense of glorifying terrorism into a tool for suppressing political speech, causing a disproportionate and unjustified infringement on freedom of expression.
On this subject, while international law offers important clarifications (I), anti-terrorism legislation introduces confusion (II) which leads to possible infringements on freedom of expression (III).
